Minutes of the regular
meeting of March 12, 2008. Mr. Kriner called the meeting to order.
Members present: Sandra Husman, Patrick
Kriner, Mayor Craig Stough, Mary Westphal (4)
present.

moved, Ms. Husman seconded to approve the Minutes of
the February 13, 2008, meeting as submitted.
Vote being: Husman, Kriner, Westphal, Stough
(4) aye; (0) nay. Motion passed by a 4 to 0 vote.

3 - Council Referral - Petition, requested by the abutting property owners to
vacate a portion of Twain Drive adjacent to Lot 153 and 154 Whetstone Park,
Sylvania. Ms. Debra Feichtinger present.
Mr. Kriner mentioned that this had been postponed from the February 13,
200 meeting to allow the planning commission to obtain legal guidance from the
city=s law department. The planning commission received a letter
from The Olander Park System and a short memo from Ms. Leslie Brinning of the
Law Department. Mayor Stough stated that
he is not sure the city wants to vacate Twain Drive. The abutting property owner is not in
agreement with the vacation request, the city has utilities in the right-of-way, and the
city may need that area for future improvements. He said that they would need permission from
the city to construct a driveway in the right-of-way and they may want to have
the zoning office assist with going to the Board of Appeals to waive the side
yard setback to match the house to the west.
Reduce the side yard from twenty-five feet (25') to six feet (6'). Twain
Drive would remain a public right-of-way. The city has a use for that right-of-way, it
has drainage in it and there is the possibility that a street could be
built. This is not a dead end that could
never be connected to another street.
Ms. Feichtinger presented pictures that show
the catch basins, the power pole, and the guy wire for the power pole. Mayor Stough moved, Ms Husman seconded to
recommend that right-of-way of Twain Drive not be vacated, that the owner be
granted permission to construct a driveway to a proposed garage location in the
rear portion of the yard within the right-of-way, and that the applicant
request a variance from the Board of Appeals to reduce the side yard setback
from the required twenty-five feet (25') to six feet (6'). Vote being: Stough, Westphal,
Husman, Kriner (4) aye; (0) nay. Motion
passed by a 4 to 0 vote. Mayor Stough
mentioned that works best for the city.
The board asked Mr. Oberly to prepare a drawing, for the members of city
council, showing the location of the utilities within the right-of-way of Twain Drive. If possible they would like toe drawing for
the next city council meeting on March 17, 2008.

moved, Ms. Husman seconded to adjourn the
meeting. All present voted aye. Meeting adjourned.
