Minutes of the Special Meeting of Council

The Council of the City of Sylvania, Ohio met in special session on Thursday, July 20, 2006 at 8:00 a.m. with Mayor Craig A. Stough in the chair. Roll was called with the following members present: John A. Borell, Jr., Mark Bula, Keith M. Haddad, Doug Haynam, Mark Luetke, Barbara R. Sears (6); absent: Dr. Read Backus. Mayor Stough noted that Dr. Backus is delayed.

Mayor Stough led the Pledge of Allegiance to the United States of America.

Mr. Haddad moved, Mr. Luetke seconded, to add a short discussion on the land acquisition request from Highland Meadows Golf Club to the agenda; roll call vote being: Borell, Bula, Haddad, Haynam, Luetke, Sears (6) yeas; (0) nays. The motion carried.

Mayor Stough stated that the special meeting was called so that zoning ordinance amendment petition no. ZA-3-2006, the zoning change request for property at 6820 Sylvania, 4020 and 4030 Franklin can be acted upon in a timely manner due to Council=s summer meeting schedule, and the applicant=s need to either move the project forward, or back out. Council did not act on the petition at the July 17 meeting in order to give the applicant time to work out a compromise plan with the neighbors.

Keith Brown, agent for the proposed owner, explained the changes to the site plan. He said that the north lot will be kept green space for now, and they would like it re-zoned to allow for the future construction of a multi-family dwelling. Dr. Backus arrived during his presentation. There was discussion on the proposed changes versus the original petition. After finalizing the changes, the neighbors indicated that they are in agreement with them.

Law Director James Moan had prepared an ordinance approving the project which had been distributed to Council. Several amendments to it were made. Mr. Haynam presented and read aloud by title only, proposed Ordinance No. 71-2006, as amended, a written copy of same having been previously furnished to each member of Council, AModifying the recommendation of the Municipal Planning Commission to approve petition for zoning ordinance amendment no. ZA-3-2006 on the petition of Keith Brown, agent for proposed owner, to change the zoning of property at 6820 W. Sylvania Ave., Sylvania, Ohio from >R-1 Single Family Large Lot Residential District= to >B-1 Limited Business and Office District=; to change the zoning of property at 4020 Franklin Dr., Sylvania, Ohio from >R-1 Single Family Large Lot Residential District= to >R-1 SUP=; and to change the zoning of property at 4030 Franklin Drive from >R-1 Single Family Large Lot Residential District= to >R-2-A Two Family Residential Small Lot District=; and declaring an emergency.@ Mr. Haynam moved, Mr. Haddad seconded, that Council dispense with the Second and Third Readings of said Ordinance, as modified; roll call vote being: Bula, Haddad, Haynam, Luetke, Sears, Backus, Borell (7) yeas; (0) nays. The motion carried.

Mr. Haynam moved, Mrs. Sears seconded, that Ordinance No. 71-2006, as modified, be enacted as an emergency measure as declared therein; roll call vote being: Haddad, Haynam, Luetke, Sears, Backus, Borell, Bula (7) yeas; (0) nays. The motion carried.

Mr. Haddad asked that the Building & Grounds Committee make a recommendation for the Highland Meadows land acquisition proposal prior to the club making an official offer. Mr. Bula stated that the club=s Board knows that their request may not be granted, but want to move forward. After a brief discussion on what constitutes green space, Mr. Luetke commented that green space should have public, not private access. Mr. Bula said that the Building & Grounds Committee will meet when an offer is received.

There were no further items for consideration or discussion and Mrs. Sears moved, Mr. Bula seconded, that this meeting adjourn; all present voting yea (7); (0) nays. The motion carried and the meeting adjourned at 8:40 a.m.
